I am sorry to have to tell you that this idea, with which many clients come to our office, unfortunately does not correspond to reality.
The aim of child maintenance in the event of divorce or separation of the parents is not only to fulfil the basic needs of the children, but also to maintain the children’s standard of living as good as possible, as it was before the separation of the parents.
If the economic situation of the parents is very different, a maintenance amount can be agreed in favor of the children, which is to be paid by the parent who is financially better off, even if both parents have joint custody.
However, the amount to be paid in this case is generally lower than the amount that would be due if one of the parents had sole custody.
It should also be noted that in the case of joint custody, where the parents do not share 50% of the time with the child, it may also be necessary to pay child maintenance.
